Judge rejects exam request in White House case (AP)

WASHINGTON ? A federal judge on Friday denied a government request for a more thorough and extensive psychiatric evaluation of a man accused of firing shots at the White House in what prosecutors say was an attempt to assassinate President Barack Obama.

The mental state of Oscar Ramiro Ortega-Hernandez, who prosecutors say harbored fantasies of killing the president, has been a critical issue since his arrest last month. A preliminary psychiatric screening already found him competent to stand trial. Prosecutors want another evaluation that conclusively puts to rest any concerns about Ortega's ability to understand the charges against him. A comprehensive evaluation would also strengthen the government's case against any later attempt by defense lawyers to use a mental health defense.

U.S. Magistrate Judge John Facciola said there was currently no evidence suggesting that Ortega is incompetent to stand trial. But he said prosecutors can renew their request as the case moves forward if they believe Ortega's mental health is deteriorating.

"A delusional system does not in and of itself compel the conclusion of a defendant's incompetence," he said.

Federal prosecutors say Ortega bought a gun and more than 1,200 rounds of ammunition in Idaho, where he lived, practiced firing it for months and then drove east with the goal of assassinating Obama. They say Ortega referred to himself as the "modern-day Jesus Christ," perceived Obama to be the antichrist and considers marijuana to be the answer to world peace. He opened fire and sped away, prosecutors say, before being arrested five days later at a Pennsylvania hotel.

Authorities located at least five bullet impact points on the south side of the White House or above the second story, court papers say, and two bullets were recovered from the White House ? including one from a window frame on the Truman Balcony. Obama and his wife, Michelle, were out of town at the time.

Elizabeth Teegarden, a clinical psychologist who interviewed Ortega for 50 minutes after his arrest, said Ortega denied delusional thinking, phobias and having aspirations to harm himself or others. When she asked him about statements in the criminal complaint that he had told others that he wanted to kill the president, he either denied the statements or refused to talk about them.

Ortega's public defender, David Bos, said Ortega not only is able to help in his defense but also "understands highly technical principles."

Esophageal Cancer: Facts and Figures (ContributorNetwork)

British journalist and author Christopher Hitchens died Thursday at 62 from complications of esophageal cancer. The well-known contributing editor of Vanity Fair magazine had been diagnosed in June 2010. Here are some key facts and figures about esophageal cancer.

* Men develop esophageal cancer four times more frequently than women and also have a higher mortality than women.

* Esophageal cancer ranks seventh as the cause of cancer deaths among men.

* This year in the United States, approximately 17,000 adults will receive a new diagnosis of esophageal cancer.

* Approximately 15,000 deaths will be attributed to esophageal cancer this year.

* The lifetime risk of esophageal cancer in the United States is estimated to be 1 in 125 for men and 1 in 400 for women.

* Symptoms include difficulty swallowing, chest pain, unexplained weight loss, fatigue, choking while eating, indigestion, vomiting, persistent hiccups and hoarseness. Symptoms frequently do not appear in the early stages of esophageal cancer.

* The most common age for esophageal cancer to occur is between 45 and 70.

* Risk factors include drinking alcohol, chewing tobacco, obesity, drinking extremely hot liquids, bile reflux, GERD, smoking, Barrett's esophagus, radiation to the upper abdomen or chest, eating foods preserved in lye and eating too few fruits and vegetables.

* Endoscopy and barium swallow are usually done to make a diagnosis of esophageal cancer.

* Since symptoms do not usually occur until the later stages, treatment options carry a poor survival rate.

* Treatment may involve surgery and almost always involves chemotherapy and radiation combined.

* In the U.S., the five-year survival rate is 17 percent, excluding patients who die from other causes. For anyone with early stage esophageal cancer, the survival rates are higher.

* Esophageal cancer is much more prevalent in countries other than the U.S. For example in places such as northern China, India, Iran and southern Africa the rates are 10 to 100 times higher,

* Two types of esophageal cancer are the most common and are named after the cells at their point of origin. These include adenocarcinoma, which begins in the lower part of the esophagus and is the most common in western societies, and is caused most often by reflux and Barrett's esophagus. The second type is squamous cell carcinoma, which begins in the lining of the middle and upper esophagus. This type is most often caused by smoking and alcohol use and is the most common worldwide.

* Squamous cell carcinoma occurs three times more often in blacks than whites, while adenocarcinoma is most prevalent in white males.

Sanchez, Gazit-Globe fail to impress on debut (Reuters)

(Reuters) ? Gazit-Globe and Sanchez Energy opened to a muted response on their trading debut, as companies without the dotcom tag find little favor with investors.

IPOs of internet companies such as Groupon Inc, Angie's List Inc and Jive Software Inc had flying starts to their listings, while those of brick-and-mortar companies haven't managed to generate comparable investor interest.

Earlier in the day, Luxfer Holdings, a maker of high-performance materials and gas cylinders, postponed its offering citing market conditions.

On Wednesday, shares of Sanchez, a developer of unconventional oil and natural gas assets, closed at $18.25, down 17 percent from their issue price of $22, after the company priced its IPO below its price range.

Last week, energy companies Rose Rock Midstream LP and Memorial Production Partners LP had also met with cold response from investors. While Texas-based Memorial Production closed a percent down from the $19 offer price, Rose Rock shares closed flat.

"These companies (energy) were trying to get more proceeds to benefit themselves rather than leaving a lot of money on table to benefit investors," Jay Ritter, finance professor at University of Florida told Reuters.

Sanchez's offering raised net proceeds of about $203 million, which it intends to use to fund capital expenditures through December 2012.

Sanchez, which mainly focuses on the Eagle Ford Shale, said it earned $3.4 million for nine months ended September 30, compared with a net loss of $3.1 million last year. For the period, its revenue was $9.9 million, compared with $1.5 million last year.

Israeli real estate investment firm Gazit-Globe, which cut its U.S. offering size by a quarter, closed at $8.83, 1.8 percent below the $9 offer price on Wednesday.

Johnson Rice & Company L.L.C. and Macquarie Capital were the lead underwriters for Sanchez's offering, while Citigroup and Deutsche Bank Securities underwrote the Gazit-Globe offering.

Rodney Atkins files for divorce following arrest

Rodney Atkins is looking to end his marriage.

On the same day we learned about his Nov. 21 arrest on domestic violence charges for allegedly trying to smother his wife with a pillow, E! News has confirmed that the country singer has officially filed for divorce.

Per his petition filed in Williamson County, Tennessee on Nov. 22, the day after he was taken into custody, Atkins cited irreconcilable differences as the reason as well as "inappropriate marital conduct" on Tammy Jo Atkins' part that "renders further cohabitation unsafe and improper."

The 42-year-old entertainer was taken into custody after his missus called 911, claiming the two had got into a violent altercation that culminated with him trying to smother her with a pillow. She also alleged he grabbed her face and threw her down a hallway in front of their 10-year-old son, Elijah.

Rodney Atkins has adamantly denied the accusations.

On the same day he moved to dissolve their marriage, a judge signed a temporary restraining order prohibiting both Rodney and Tammy from "harassing, threatening, assaulting or abusing the other party."

Additionally, the court barred them from disposing of any marital property or relocating their children outside the state without the court's permission (Rodney also has two step-daughters).

The country star seeks joint custody of Elijah.

In her counter-complaint, Tammy also cites irreconcilable differences and asks that the court grant her sole custody of the boy. In addition, she's seeking alimony, child support and legal fees from her estranged hubby.
